株式会社麦島建設長野営業所長は、他の者と共謀の上、長野県南木曽町が入札を執行した指名競争入札に関し、偽計を用いて公の入札で契約を締結するためのものの公正を妨害する行為を行った。 これにより、同社長野営業所長が令和５年１１月１４日付で刑法第９６条の６第１項（公契約関係競売入札妨害）の罪により木曽福島簡易裁判所から罰金の略式命令を受け、その刑が確定している。 このことは、建設業法第２８条第１項第２号及び第３号に該当すると認められる。
