有限会社成瀬舗設は、神奈川県横浜市の整地工事において、令和６年７月23日、車両系建設機械であるローラーを使用して配下の労働者に当該工事の転圧作業を行わせるにあたり、転圧する敷地端部が傾斜で、その先に1.2メートルの段差があり、同ローラーの転倒又は転落により労働者に危険が生ずるおそれがあったのに、同ローラー誘導のための誘導員を配置せず、もって機械による危険を防止するため必要な措置を講じていなかった。 以上のことが、労働安全衛生法（昭和47年法律第57号）第20条第１号、労働安全衛生規則（昭和47年労働省令第32号）第157条第２項、労働安全衛生法第119条第１号、並びに労働安全衛生法第122条に違反し、令和７年４月10日、有限会社成瀬舗設及び工事課長が罰金刑に処せられた。 このことが、建設業法第28条第１項第３号に該当する。
