The company was ordered to pay a fine of 200,000 yen by the Yanai Summary Court after being found in violation of Article 119, Item 1; Article 20, Item 1; and Article 27, Paragraph 1 of the Industrial Safety and Health Act, as well as Articles 157, Paragraphs 1 and 2 of the Industrial Safety and Health Regulations. The penalty was finalized on October 27, 2023. This is recognized as corresponding to Article 28, Paragraph 1, Item 3 of the Construction Business Act.

令和４年１２月２９日、光陽重機の九門重八は、車両系建設機械であるドラグ・ショベルを用いて、山口県大島郡周防大島町大字日前地内の仮設道路の締固め作業を行わせるにあたり、同ドラグ・ショベルの運行経路が傾斜地でドラグ・ショベルが転倒することにより労働者に危険を及ぼすおそれがあったのに、ドラグ・ショベルの運行経路について傾斜を緩やかにする等転倒を防止するための必要な措置を講じず、もって機械、器具その他の設備による危険を防止するための必要な措置を講じなかった。 労働安全衛生法第１１９条第１号、第２０条第１号、第２７条１項及び労働安全衛生規則第１５７条第１項、２項に違反するとして、柳井簡易裁判所から罰金２０万円の略式命令を受け、令和５年１０月２７日に刑が確定した。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
