中山塗装は、令和７年１２月１８日、鳥取県米子市の皆生住宅屋根塗装工事現場において、労働者を使用して建物２階屋根を作業床として塗装作業を行わせるに当たり、当該作業場所は、地上から５.９１メートルの高さに位置し、墜落により労働者に危険を及ぼすおそれがあり、かつ、建物２階の屋根端部に外部足場を組み立てて囲いや手すりを設置することが容易であったのに、当該措置を講じないまま作業を行わせ、もって労働者が墜落するおそれのある場所にかかる危険を防止するための必要な措置を講じなかった。この件について、同社に対し、米子簡易裁判所から労働安全衛生法違反による罰金刑の略式命令があり、令和８年５月２９日にその刑が確定している。このことは、建設業法第２８条第１項第３号に該当する。
