| Summary | Otaki Construction Co., Ltd., a secondary subcontractor involved in the raising work of the second West breakwater at Niigata Port (West Port area), was found to have failed in safety management duties. On June 24, 2021, the site manager, who oversaw construction and safety management, allowed workers to attach formwork to a suspended scaffold on the sea side without taking necessary measures to prevent the scaffold from falling into the sea, despite the risk of such a fall. As a result, the scaffold was overloaded on the sea side, causing two employees working on it to fall into the sea; one was killed and the other injured. The company and the site manager were convicted of occupational negligence resulting in death and injury, and violations of the Industrial Safety and Health Act, with fines imposed and the penalty confirmed on September 12, 2023. This constitutes a violation of Article 28, Paragraph 1, Item 3 of the Construction Business Act. The prefectural authorities issued a three-day suspension of business operations from December 5 to December 7, 2023, limited to the construction of piling, earthwork, and concrete work related to public projects, as per the permit number Niigata Prefecture Governor Permit (General-3) No. 385. |
