1. The construction company engaged in construction work in Kobe City, Hyogo Prefecture, primarily involving waterproofing and painting, which requires a waterproofing permit. The company contracted the work from Company A without obtaining the permit, in violation of Article 3, Paragraph 1 of the Construction Business Act, despite the contract amount exceeding the threshold set in Enforcement Order of the Construction Business Act, Article 1-2. 2. Company A initially planned to have Ise Komuten subcontract the main part of the work. However, just before the start date, it was discovered that Ise Komuten lacked the necessary construction permit. Consequently, Company A directly contracted with the construction company, which then subcontracted to Ise Komuten, collectively undertaking the work. Company A also appointed Ise Komuten as the site supervisor, assigning its own technicians to support the overall construction management. The construction company, under these circumstances, entered into a subcontract with Ise Komuten without the required permit, violating Article 3, Paragraph 1 of the Construction Business Act. 3. The construction company violated Article 22, Paragraph 1 of the Construction Business Act by consolidating the contracted construction work with Ise Komuten and, contrary to Paragraph 2, subcontracted the entire work to Ise Komuten.
