令和４年１２月２０日、貴社から近畿統括本部吹田総合車両所京都支所内において、構内業務を委託している会社（以下「委託会社」という。）の構内運転士が過去１年間に計８回、酒気を帯びた状態で車両に乗務していたこと及びアルコール検知器を用いた検査による酒気帯びの有無の確認が適切に行われていないことの報告があった。 これを受けて、令和４年１２月２１日、２２日及び２３日に保安監査を実施したところ、記１．及び記２．のとおり改善を要する事項が認められたことから、記３．のとおり所要の措置を講ずるよう指示する。 改善措置を講ずるにあたっては、当該事項に係る業務の実施方法、実施状況、管理方法等の妥当性について検証する等により、背後要因を含め当該事項が発生した原因を究明したうえで、再発防止に必要な改善策を策定するとともに、鉄道輸送の安全に係る業務が確実に実施できるよう留意すること。 講じた措置については、令和５年４月２４日までに報告されたい。 なお、記２．（２）については、同種の案件に関して、中国運輸局が貴社に対し保安監査を実施した結果、改善を要すると認められた事項であり、記３．については中国運輸局長の指示を兼ねるものである。 記 １．近畿統括本部吹田総合車両所京都支所内において、委託会社の指導責任者である構内運転士（以下「当該運転士」という。）が、貴社の運転取扱実施基準規程第５条の規定に違反し、酒気を帯びた状態で車両に乗務していたことを確認した。 この原因として、貴社の運転取扱実施基準規程細則第２条の３に酒気帯びの有無の確認は、点呼執行者が構内運転士と対面で行い、目視等によるほかアルコール検知器を用いることと規定されているが、以下のとおり適切に行っていないことを確認した。 （１）当該運転士は、アルコール検知器を用いた検査を、委託会社の点呼執行者不在の時間帯に単独で行い、アルコール検知器で呼気中のアルコールが検知されたにもかかわらず、委託会社の点呼執行者に０mg/ℓと虚偽の申告をしていたこと。 （２）当該運転士は、アルコール検知器を用いた検査を行うことなく、委託会社の点呼執行者に０mg/ℓと虚偽の申告をしていたこと。 （３）委託会社の点呼執行者は、上記（１）及び（２）の際、アルコール検知器を用いた検査を対面で行うことなく、当該運転士の申告を信用し、記録簿に０mg/ℓと記載していたこと。 ２．貴社の運転取扱実施基準規程細則第２条の３に酒気帯びの有無の確認は、点呼執行者が構内運転士と対面で行い、目視等によるほかアルコール検知器を用いることと規定されているが、以下のとおり適切に行っていないことを確認した。 （１）近畿統括本部吹田総合車両所京都支所において、貴社の点呼執行者は、貴社の本線運転士及び委託会社の構内運転士に対し、泊り勤務の起床時点呼の際のアルコール検知器を用いた検査は必要ないと誤った認識により、当該検査を行っていなかったこと。 （２）中国統括本部後藤総合車両所運用検修センターで車両の入換を行う委託会社の構内運転士に対し、委託会社の点呼執行者は、多忙により始業点呼の際にアルコール検知器を用いた検査を対面で確認することなく、記録簿に０mg/ ℓと憶測で記載していたこと。 ３．上記のとおり、今般、貴社及び委託会社において鉄道輸送の安全に影響を及ぼす重大な違反行為が生じたことについて、安全管理体制が有効に機能していないことが認められたことから、以下のとおり所要の措置を講ずることを指示する。 （１）運転士が酒気を帯びた状態で列車等に乗務しないように、貴社及び委託会社の運転士と点呼執行者に対して、飲酒に関する安全意識の再徹底並びに法令及び規程等の遵守に係る再教育を行うこと。 （２）貴社及び委託会社において、運転士に対する酒気帯びの有無の確認に当たっては、点呼執行者が運転士と対面で行い、目視等によるほかアルコール検知器を用いた検査が確実に行われるよう体制を見直すこと。 （３）貴社における鉄道輸送の安全を確保するため、貴社自らが問題点を見つけ改善することができるよう安全管理体制を再構築すること。 【近畿運輸局】
