貴社の市橋線において、実施基準運転関係にはスタフ閉そく式を施行して列車を運転すると規定しているにもかかわらず、実際にはそのとおり運転していないとの情報が当局のホームページご意見箱に通報された。このことから、貴社に対して、令和３年７月２０日、２１日、２７日、２８日、８月４日、５日、６日及び１７日に保安監査を実施したところであるが、監査の結果、以下のとおり改善を要する事項が認められたことから、改善措置を講ずるよう指示する。講じた措置については、令和３年１１月２２日までに報告されたい。記１．安全管理体制について以下の事項を確認した。・安全管理体制の実態が安全管理規程で規定する組織体制と一致していないこと。また、管理者が安全管理規程で規定する責務を遂行していないこと。・管理者による鉄道係員の人材育成等が安全管理規程どおり行われておらず、車両の検査において測定する理由を理解せずに作業を行うなど鉄道係員のスキルが不十分であること。このように、貴社では安全管理体制が構築されているとは言えず、このために下記２．及び３．の法令及び実施基準に従った取扱いができていないものと考えられる。ついては、輸送の安全を確保するためにも、安全管理規程で規定する組織体制と実態を一致させるとともに、以下のとおり改善措置を講ずること。（１）管理者は、現場の状況を的確に把握する体制を整備した上で、現場の業務の実施状況を定期的に検証して、課題を整理し、必要な改善を継続的に行うとともに、改善の実行性が確保されるよう安全管理体制の構築を図ること。（２）管理者は、施設及び車両の維持管理並びに運転取扱いが実施基準等の規定に従って実施できるよう、鉄道係員に対し必要な教育及び訓練を適切に行うこと。２．法令に従った取扱いが以下のとおり行われていないことを確認した。これらについては、関係法令の理解を深め、同法に基づく手続きを確実に行うよう必要な措置を講ずること。（１）乙女坂駅構内の分岐器の交換及びまくらぎのＰＣ化について、鉄道事業法第１２条に規定する鉄道施設の変更の手続きを行っていなかったこと。（２）鉄道事故等報告規則第５条第４項に規定する鉄道運転事故等届出書について、平成３０年２月２８日、平成３１年２月１２日及び令和３年１月２０日に輸送障害が発生しているにもかかわらず、同届出書が届出されていなかったこと。３．施設及び車両の検査・整備並びに運転取扱いにおいて、実施基準に従った取扱いが以下のとおり行われていないことを確認した。これらについては、改めて実施基準の内容を社内に周知徹底し、遵守すること。（１）施設関係 ① 実施基準軌道関係第３０条の２で規定する軌道変位検査のうち通りについて、整備基準値を超過している箇所に対し、線路検査整備内規に基づき必要な整備を実施していなかったこと。 ② 実施基準軌道関係第３２条で規定する本線の巡視について、「４日に１回以上は実施するものとする。」とされているところ、一部の区間において、巡視の間隔が４日を超えていたこと。 ③ 実施基準軌道関係第３３条で規定する施設の定期検査のうち遊間検査について、検査基準日から起算した許容期間に至る前に検査を実施していたこと。 ④ 実施基準電気信号関係第１２条に規定する運転専用電話について、撤去廃止していたこと。 ⑤ 信号保安装置マニュアル（実施基準）第２１条及び第２２条で規定する定期検査について、保安通信設備（運転専用電話）にかかる検査項目が同実施基準に規定されていないため通常検査及び精密検査を行っていないこと並びに踏切保安設備の精密検査を実施していないことを確認した。また、これら設備の定期検査を委託する際に、対象設備や検査項目について明確に指示をしていなかったこと。（２）車両関係 ① 車両整備マニュアル（実施基準）第６条で規定する列車の検査について、「２日を超えない範囲で検査を行うものとする。」とされているところ、一部の列車において、検査の周期が２日を超えていたこと。 ② 車両整備マニュアル（実施基準）第８条で規定する重要部検査について、動力発生装置の機関本体の分解検査及び探傷検査を実施していなかったこと。（３）運転取扱い関係 ① 実施基準運転関係第２９条に規定する列車の運転時刻による取扱いについて、鉄道事業法第１７条により規定する運行計画に定められた運転時刻どおり運行していなかったこと。 ② 実施基準運転関係第１１条に規定する機関士への出勤点呼及び帰着点呼について、同実施基準で規定する点呼執行者である機関区長又は助役以外の当務駅長が実施していたこと。 ③ 実施基準運転関係第３５条及び第１７５条に規定する出発合図について、同実施基準で規定する駅長等による出発合図を行っておらず、また、機関士は出発合図を受けることなく、列車を出発させていたこと。 ④ 実施基準運転関係第５２条に規定する列車を組成したときのブレーキテストについて、美濃赤坂駅においてＪＲ貨物の機関車から自社の機関車に付け替えた際に、実施していなかったこと。 ⑤ 実施基準運転関係第８３条及び第８７条に規定するスタフ閉そく式について、平成１７年４月頃から令和３年４月１２日までの間ほとんど施行していなかったこと及びスタフ閉そく式の施行区間について同実施基準第９１条とスタフ閉そく式の実態が一致していなかったこと。【中部運輸局】
