令和３年１１月８日から１１月１１日まで、貴社に対して保安監査を実施したところであるが、監査の結果、改善を要する事項が認められたことから、下記の事項について、改善措置を講ずるよう指示する。 講じた措置については、令和４年２月１４日までに報告されたい。 記 以下の事項の改善措置を講ずるにあたっては、発生した背後要因を含めて原因を究明した上で、再発防止のための措置を講ずること。 １．軌道・土木施設実施基準第９７条に規定するレール及び継目部の検査のうちトンネルを除く全ての直線部及び一部の曲線部（５k８６２m～５k８８２m）のレールの摩耗状態の検査を実施していないことを確認した。 よって、軌道・土木施設実施基準に基づく当該箇所のレールの摩耗状態の検査について速やかに計画を立て実施するとともに、同検査の結果に基づき、必要に応じ適切な措置を講じること。 ２．車両構造・整備実施基準第６７条の別表３及び４に規定する重要部検査及び全般検査における車体屋根の検査について、実施していないことを確認した。 よって、同実施基準に基づき、確実な検査の実施及び適切な管理ができるよう必要な措置を講じること。 ３．平成３１年３月、定期に運行する一部列車の発着時刻の変更を行ったが、鉄道事業法第１７条及び同法施行規則第３５条の規定に基づく列車の運行計画の変更届出を行っていないことを確認した。 よって、同法に基づく所要の手続きを速やかに行うとともに、今後当該手続きが確実に行われるよう必要な措置を講じること。 ４．鉄道事業動力車操縦者資質管理報告規則第２条の規定に基づき当局に提出された動力車操縦者資質管理報告書において、報告時期の誤りがあることを確認した。 よって、過去に当局へ提出した動力車操縦者資質管理報告書を再度確認し、訂正が必要なものについては再提出するとともに、同規則を関係者に正しく理解させ、当該報告が適正に行われる体制を構築すること。 ５．運転取扱実施基準第８条に規定する列車又は車両を操縦する係員に対して行う酒気帯びの有無の確認において、次の(1)～(3)のことを確認した。 (1) 仕業前後に対面（運行上やむを得ない場合は電話その他の方法）により、酒気帯びの有無を確認することとなっているが、仕業後の酒気帯びの有無の確認を実施していないこと。 (2) 酒気帯びの有無の確認の都度、酒気帯びの有無（目視等の確認結果、アルコール検知器で測定した数値）を記録することとなっているが、仕業前の確認において、アルコール検査実施済みの記録はしているが、使用中のアルコール検知器が測定した数値を表示できないものであることから、アルコール検知器で測定した数値を記録していないこと。 (3) 社内規程では、仕業前のアルコール検査で酒気帯びが確認された場合の乗務の禁止しか規定されておらず、「鉄道に関する技術上の基準を定める省令等の制定に伴う取扱いについて」（平成１４年３月８日付け国鉄技第１６４号）に示すアルコール検査に関する取扱いのうち、運転取扱実施基準に定めていない事項を規定していなかったこと。 よって、運転取扱実施基準に基づく仕業後の酒気帯びの有無の確認及び仕業前後の酒気帯びの有無の記録について、社内規程の改正を行った上で速やかに実施するとともに、同実施基準に基づく列車又は車両を操縦する係員に対して行う酒気帯びの有無の確認が適切に実施することができる体制を構築すること。 なお、体制が構築されるまでの間については、運転取扱実施基準に経過措置を規定するための所要の手続きを行うこと。 【関東運輸局】
