| Original Japanese text | 令和５年４月１１日に長尾線上福岡踏切道において、踏切遮断機が遮断していない状態で列車が踏切内に進入した事象（以下「踏切無遮断」という。）の発生を受け、貴社に対して、同年４月１３日、１４日及び２６日に保安監査を実施した結果、同種事象の再発防止ための対策を講ずるよう指示したところである。 これに対する再発防止の検討を進めていたにもかかわらず、令和５年７月１３日に琴平線下所川第一踏切道で、同年８月１９日に琴平線円座踏切道で同種事象を発生させた。 これを受けて、貴社に対して、令和５年８月２３日、２４日及び２５日に保安監査を実施したところ、下記のとおり過去に発生させた踏切無遮断の対策に関し、改善を要する事項が認められたことから、所要の措置を講ずるよう指示する。 改善措置を講ずるにあたっては、当該事項に係る業務の実施方法、実施状況、管理方法等の妥当性について検証する等により、背後要因を含め当該事項が発生した原因を究明したうえで、再発防止に必要な改善策を策定するとともに、輸送の安全に係る業務が確実に実施できるよう留意すること。 なお、講じた措置については、令和６年１月３１日までに報告されたい。 記 １．令和２年度に保安監査を実施し、令和３年３月３１日付け四運鉄監第２２号「保安監査の結果について」で改善措置を講ずるよう指示したところ、令和３年６月３０日付け高琴鉄技電発第１４号「保安監査結果の改善指示事項に対する措置について（報告）」において、踏切保安設備の検査は、運転保安設備実施基準第７２条に基づく別表「信号通信設備検査方法」に加え、新たに作成した「踏切点検マニュアル」（以下「マニュアル」という。）に基づき実施するとしていたが、踏切無遮断の再発防止対策であり、マニュアルの一部である「遮断桿最大上昇時の回路制御器点検方法」を実施していなかったことを確認した。 また、マニュアルに関する教育・訓練については、マニュアル作成時の臨時教育１回のみの実施であり、その後、定期的な教育・訓練が実施されていなかったことを確認した。 よって、現時点で未実施の検査がある場合には速やかに実施するとともに、検査に関する教育・訓練の実施方法についても検討し、適切な検査を今後も継続的に実施するための体制を構築すること。 ２．この指示に従わず、安全管理体制の改善が確認できない場合や、再び違反行為があった場合には、以下のとおり、事業の改善を命ずる場合がある。 （１）事業改善命令を行使し得る根拠となる法令の条項（行政手続法第３５条第２項第１号） 鉄道事業法第２３条 （２）上記の条項に規定する要件（行政手続法第３５条第２項第２号） 鉄道事業法第２３条の鉄道事業者の事業について、輸送の安全その他公共の利益を阻害している事実があると認められること。 （３）当該権限の行使が上記の要件に適合する理由（行政手続法第３５条第２項第３号） 輸送の安全その他公共の利益を阻害している事実が確認され、鉄道事業法第２３条第１項第３号及び第６号で定める措置を講ずる必要があるため。 以上 【四国運輸局】 |
