有限会社佐野解体及び同社役員は、同社の処分場において、労働者に車両系建設機械である解体用つかみ機を運転させて、木材がらの運搬作業を行わせるに当たり、法定の除外事由がないのに、運転中の同解体用つかみ機に接触することにより労働者に危険が生ずるおそれのある箇所に労働者を立ち入らせないようにする措置を講ぜず、もって機械等による危険を防止するための必要な措置を講じなかった。 この件について、富士簡易裁判所は令和５年４月13日に同社及び同社役員に対し、労働安全衛生法違反に基づきそれぞれ罰金20万円の略式命令を行い、これが確定した。 このことは建設業法第28条第1項第３号に該当するものと認められる。
