有限会社優栄土木の元役員は、産業廃棄物であるタイヤ６本合計約36㎏を、富士宮市北山字堀ノ内の畑で焼却したことにより起訴され、廃棄物の処理及び清掃に関する法律等に基づき罰金30万円の有罪判決を受け、その刑が確定した。 このことが、建設業法第28条第１項第３号に該当することから、同法第28条第３項に該当すると認められる。
