当該建設業者は、八尾市内の民間発注の工事において、建設業法第19条の規定に違反して、当該工事に係る同条第１項の書面を発注者に交付しなかったため、発注者との間に契約の直接の相手方が誰であるかについての紛争が生じた。そして、発注者の当初の意図とは異なり、風呂場、キッチン、洗面所、洗濯場及びトイレの解体工事、配管工事及び設備設置工事（以下「別工事」という。）は、別の業者が発注者から直接請け負うこととなった。そのために発注者が意図していた当該工事と別工事全体を総合的な企画、指導、調整のもとに完成することができなくなった。 その結果、当該工事は、総合的な企画、指導、調整のもとに建築物を建設する工事（建築一式工事）ではなくなり、当該建設業者は、建設業法第３条第１項の規定に違反し、内装仕上工事業に係る同項の許可を受けないで請負代金が建設業法施行令第１条の２に定める金額以上となる建設工事を請け負った。
