有限会社小平建設及び同社代表取締役は、諏訪郡富士見町境所在の令和元年度防災・安全交付金（火山砂防）（重点）工事において、令和２年12月22日同社従業員が、同社代表取締役が運転するドラグ・ショベルのバケットにコンクリートブロックを積み込む作業を行っていたところ、左足を負傷し、同日から４日以上休業することになったにもかかわらず、所轄の岡谷労働基準監督署長に対し、遅滞なく、労働者死傷病報告を提出しなかった。 このことにより、有限会社小平建設及び同社代表取締役は労働安全衛生法違反により、各々罰金30万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する
