株式会社湘南レオテックは、神奈川県藤沢市円行一丁目15番22号に本店登記をして建設業を営む事業者、違反行為者であるＡは、同社の代表取締役会長として同社の出納関係を担当し、同社が施工する工事のうち自身が担当する工事に係る労働者の安全衛生管理、業務の中で発生した労働災害について労働基準監督署長に労働者死傷病報告を作成及び提出する等の業務を担当する者、違反行為者であるＢは同社の代表取締役社長として、同社が施工する工事のうち自身が担当する工事に係る労働者の安全衛生管理、業務の中で発生した労働災害について労働基準監督署長に労働者死傷病報告を作成及び提出する等の業務を担当する者であるが、両名は共謀のうえ、同社の労働者Ｃが令和３年４月９日に神奈川県川崎市麻生区虹ヶ丘二丁目３－12所在の虹ヶ丘団地３－12号棟付近の外構フェンスの改修工事において、使用していたハンマーで左手を殴打することにより、休業見込約４か月の傷害を負い、休業４日以上を要する労働災害が発生したのにもかかわらず、所轄の川崎北労働基準監督署長に対し、遅滞なく、労働安全衛生法第100条第１項の規定による報告をしなければならなかったのに、令和４年４月26日に至るまでこれをしなかった。 その結果、株式会社湘南レオテック及び同社の代表取締役Ａ、Ｂが、川崎簡易裁判所から労働安全衛生法違反でそれぞれ罰金20万円の略式命令を受け、令和５年３月23日にその刑が確定した。 このことは建設業法第28条第１項第３号に該当する。
