株式会社西奈美組の前代表取締役が、新発田地域振興局農村整備部発注の、「平木田柳原地区取水工第１次工事」において、当該工事の予定価格の教示を受け、同工事を落札し、もって偽計を用いて公の入札の公正を害すべき行為をしたことにより、令和５年10月11日に公契約関係競売等妨害の容疑で逮捕された。その後、同年11月１日に罰金刑に処され、同月16日にその刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
