株式会社丸い組は、令和2年2月27日頃から同年3月2日頃までの間、燕市五千石字申明4534番2所在の同社所有地に、産業廃棄物であるガラス・コンクリートくず、陶磁器くず等約350キログラム及び特別管理産業廃棄物である廃石綿等約780キログラムを埋め、もってみだりに廃棄物を捨てた。 このことが廃棄物処理法違反にあたり、令和3年1月21日付けで新潟地方裁判所三条支部から、法人に対し罰金300万円、同法人の元役員に対し懲役1年6ヶ月（執行猶予3年）及び罰金150万円の判決を受け、その刑が確定している。 このことが建設業法第28条第1項第3号に該当する。
