ウベボード山陰株式会社は、 １ 建設業法第２６条第３項及び建設業法施行令第２７条により専任の主任技術者の配置が義務づけられている民間発注のタイル・レンガ・ブロック工事に、建設業法第７条第２号に規定する営業所の専任技術者を配置した。 ２ また、上記１の工事と工期が重複する他の工事に主任技術者として営業所の専任技術者を配置した。 ３ 更に上記１、２の営業所の専任技術者が遠方工事の主任技術者として配置され、営業所に専任しているとは認めがたい状態であった。 ４ 加えて、建設業法第２６条第３項及び建設業法施行令第２７条により専任の主任技術者の配置が義務づけられている民間発注のタイル・レンガ・ブロック工事の主任技術者を工期の重複する他の工事へ配置した。 上記１～４は建設業法第７条第２号及び建設業法第２６条第３項に違反するため、同法第２６条本文及び第１項第２号に該当する。
