被処分者は、彦根市地先における民間工事において、建設業法第３条第１項第２号に掲げる区分による特定建設業許可を得ていないのに、同法第16条第２号の規定に違反して、下請代金の額が同号の政令で定める金額（令和６年政令第366号による改正前の金額）以上となる下請契約を締結した。 このことが、同法第28条第３項（同法第28条第1項第2号該当）に該当すると認められる。
