株式会社チュウオは、川崎町発注の土木工事において、土木工事の許可が失効していたにもかかわらず、建設業法施行令第1条の2第1項に定める軽微な建設工事の範囲を超える請負契約を締結した。また、建設業法第27条の23第１項で規定する経営事項審査を継続して受審せず、同法施行令に定める建設工事を発注者から直接請け負うことができない期間が生じていたにもかかわらず、この間に川崎町が発注する土木工事の入札に参加し、請負契約を締結した。以上のことは、建設業法第3条第1項及び同法第27条の23第1項に違反する行為であり、同法第28条第1項第2号に該当する。
