株式会社テレネットプランは、土木、とび・土工、石、鋼構造、舗装、しゅんせつ、塗装及び水道施設工事業で登録していた専任技術者が、令和4年9月20日に退職したことで、建設業法第7条第2号の許可基準を満たさなくなり、許可要件を欠いた状態にあった。 また、専任技術者が不在となったときには、2週間以内に同法第11条第5項に規定する届出書（変更届）を知事に提出しなければならないにもかかわらず、令和6年6月20日に至るまで届出を行わなかった。 さらに、代わりの専任技術者が不在であったことから、同法第7条第2号の許可基準を満たさなくなった場合、30日以内に同法第12条第5号に規定する届出書（廃業届）を知事に提出しなければならないにもかかわらず、令和6年6月20日に至るまで届出を行わなかった。 このことは、同法第7条第2号、同法第11条第5項及び同法第12条第5号に違反し、同法第28条第1項（本文該当）に該当するものと認められる。
