当該建設業者は、大阪市内の大阪府発注の建設工事の請負契約に係る一般競争入札において、同一のIPアドレスより当該建設業者、岡本建設工業株式会社及び株式会社ユタカが入札参加申請を行った上、同一のIPアドレスより当該建設業者及び株式会社ユタカが入札を行い、岡本建設工業株式会社及びリノヴェ大都株式会社を含めこれら４社の入札書に添付された工事費内訳書記載の直接工事費を全く同一とし、大阪府建設工事電子入札心得第３条第３項の「入札参加者は、落札者の決定前に、他の入札参加者に対して入札価格又は工事費内訳書の内容を開示してはならない。」との規定に違反するなど、公共工事の入札及び契約手続について不正行為等を行った。
