合同会社そうごう建設代表社員加戸良昌は、令和２年７月２０日、千葉県君津市山高原での道路改良工事において、モルタルの吹付に使用していたガン機の調整を労働者に行わせるに当たり、同調整作業中に同機が運転を開始すれば作業中の労働者に危険を及ぼすおそれがあったのに、危険を防止するために必要な措置を講じなかった。 当該事実に基づき、木更津簡易裁判所から令和４年４月５日付け令和４年（い）第３３号略式命令において、労働安全衛生法違反により、同人が罰金２０万円の刑に処せられた。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
