Futaba Manufacturing Co., Ltd. was involved in a tank accessory inspection equipment construction project in Oga City, Akita Prefecture, where on May 29, 2023, a generator's oil pan fell during lifting with a crane and collided with a worker inside the tank, resulting in death. The company failed to implement measures to prevent falling objects, such as setting up restricted entry zones, despite the risk of falling causing danger to workers. Although the oil pan was previously unfastened from the generator, it was not securely removed, and the company neglected its duty to prevent falling, leading to the oil pan dropping and causing the worker's death. On September 18, 2025, the Oga Summary Court sentenced the company to a fine of 300,000 yen and one employee to a fine of 500,000 yen for violations of the Industrial Safety and Health Act and for occupational negligence resulting in death. This case is recognized as applicable under Article 28, Paragraph 1, Item 3 of the Construction Business Act.

Cause of action

株式会社双葉製作所が一次下請けとして請け負った秋田県男鹿市におけるタンク付属品点検設備工事において、令和５年５月２９日、発電機をクレーンでつり上げてタンク内に搬入する際、発電機のオイルパンが落下し、タンク内で作業中の労働者１名と衝突し死亡する事故が発生した。 この事故について、発電機をクレーンでつり上げて搬入する作業を労働者に行わせるに当たり、発電機等が落下することにより、労働者に危険を及ぼすおそれがあったにも関わらず、立入区域を設定する等物体の落下による労働者の危険を防止するための措置を講じなかった。また、あらかじめ発電機からオイルパンの結束を解いていたものの、確実に取り外しておらず、作業時にオイルパンが落下して労働者に衝突するおそれがあったにも関わらず、落下防止の注意義務があるのにこれを怠り、漫然と機材の搬入を開始させた過失により、オイルパンを発電機から落下させ、労働者１名と衝突させ死亡させた。 この件について、令和７年９月１８日に男鹿簡易裁判所から、同社は労働安全衛生法違反及び業務上過失致死により罰金３０万円、同社社員１名は労働安全衛生法違反及び業務上過失致死により罰金５０万円の略式命令を受け、それぞれその刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
