当該建設業を営む者は、枚方市内の民間発注の工事において、発注者から本件工事の注文を請け、これを請け負い完成することを発注者に対して約し、発注者は請負代金を支払うことを当該建設業者に対して約するなど、建設業法第３条第１項の規定に違反して同項の許可を受けないで請負代金の額が建設業法施行令第１条の２に定める金額以上となる建設工事を発注者から請け負った。
