株式会社サッポロフェンスは、令和２年 12 月 25 日に砂川市の工事現場で、移動式クレーンによる作業中に作業員がその荷台から墜落し、負傷したにもかかわらず、自社の作業場で負傷したとする旨の虚偽の労働者死傷病報告書を令和３年１月 21 日に札幌東労働基準監督署長に提出した。 このことにより、労働安全衛生法第 100 条第１項及び労働安全衛生規則第 97 条第１項に基づき、札幌簡易裁判所において、同法人及び同法人役員が罰金刑に処せられ、刑が確定した。 このことは、建設業法第２８条第１項第３号に該当するものである。
