株式会社ササデンは、神奈川県横須賀市内川一丁目６番地24号に本店を置いて電気工事業を営み、株式会社○○から請け負った電柱取り換え工事を行う事業者、違反行為者であるＡは、同社所属の労働者で、同工事の作業長として同工事における安全管理を行う者であるが、違反行為者であるＡは同社の業務に関し、令和４年３月17日、同工事に使用する電柱の置場である神奈川県横須賀市根岸町三丁目５番地13号において、移動式クレーンを用いて作業を行うに当たり、移動式クレーンを用いてワイヤーロープで一箇所に玉掛けを行い荷を吊り上げる際に、荷の下に労働者を立ち入らせ、また、移動式クレーンの転倒等による労働者の危険を防止するため、あらかじめ、当該作業に係る場所の広さ、地形及び地質の状態、運搬しようとする荷の重量、使用する移動式クレーンの種類及び能力等を考慮して作業方法等を定めずに作業を行った。 その結果、同社及びＡが横須賀簡易裁判所から労働安全衛生法違反でそれぞれ罰金20万円の略式命令を受け、令和４年12月14日にその刑が確定した。 このことは建設業法第28条第１項第３号に該当する。
