Cause of action

当該建設業者は、主任技術者の配置に専任を要する枚方市内の民間発注の工事（大規模修繕工事）において、建設業法第26条第３項の規定に違反して、工期の重複する高槻市内及び吹田市内の民間発注の工事（大規模修繕工事）並びに吹田市内の民間発注の工事（改修工事）に配置した主任技術者を、専任を要しない主任技術者として工事現場に配置した。 また、当該建設業者は、上記の枚方市内の工事において、その請け負った建設工事を北田塗装等に請け負わせたにも関わらず、建設業法第24条の８第２項の規定に違反して、発注者から直接その工事を請け負った特定建設業者に対し、再下請負の通知を行わなかった。さらに、豊中市内の民間発注の工事（大規模修繕工事）において、同項の規定に違反して、発注者から直接その工事を請け負った特定建設業者に対し、１次下請負人である当該建設業者が直接請け負わせていない３次下請負人であった長谷川技建、西栄等に直接請け負わせたとの内容の再下請負の通知を行った。
