当該建設業者は、建設業法第15条第２号に規定する特定営業所技術者である者が、常勤して専ら職務に従事しておらず、建築工事業、大工工事業、左官工事業、とび・土工工事業、石工事業、屋根工事業、タイル・れんが・ブロツク工事業、鋼構造物工事業、板金工事業、ガラス工事業、塗装工事業、防水工事業、内装仕上工事業、熱絶縁工事業、建具工事業及び解体工事業に係る同号の許可の基準を満たしていなかった。 また、当該建設業者は、大阪府に提出した建設業法第５条及び第６条に基づく建設業許可申請書類において、建設業法第15条第２号に規定する特定営業所技術者である者が同社から給与の支払いを受けていないなど、常勤して専ら職務に従事しないにも関わらず、同人を同号に規定する特定営業所技術者として営業所に置くとするなどの虚偽の内容を記載し、同法第３条第１項の許可を受けた。 さらに、当該建設業者は、許可を受けた全部の業種に係る特定建設業の許可を廃止したとの建設業法第12条第５号に該当する旨の同条の規定による届出をした。
