清田建築は、自ら建築した住宅を施主に引き渡すに際し、特定住宅瑕疵担保責任の履行の確保等に関する法律第３条に規定されている、瑕疵担保責任を果たすために必要な保証金の供託、又は住宅建設瑕疵担保責任保険への加入を行っておらず、加えて、同法第４条に定める保証金の供託又は保険への加入状況について、県への届出をしていなかった。 また、同法第３条、第４条に違反した状態のまま、新たに住宅を新築する建設工事の請負契約を締結していた。 このことが、建設業法第28条第１項第９号に該当する。
