株式会社ナカテックの元営業工事部課長は、日野町が令和２年９月18日に入札を執行した「第61－工農集１号農業集落排水事業東桜谷地区機能強化対策工事（その１）」の指名競争入札に関し、日野町職員と共謀の上、同職員から、同入札における秘密事項である同工事の最低制限価格に近接した金額の教示を受け、よって、同工事の入札において、同社をして、最低制限価格に近接した金額で入札させて同工事を落札させ、もって偽計を用いて公の入札で契約を締結するためのものの公正を害すべき行為を行った。 これにより、株式会社ナカテックの元営業工事部課長は、公契約関係競売入札妨害の罪により、令和４年６月23日に大津地方裁判所から、懲役１年（執行猶予３年）の判決を受け、令和４年７月８日にその刑が確定した。 このことが、建設業法第28条第１項第２号および令和２年11月16日施行の滋賀県建設業者等の不正行為等に対する監督処分の基準第６の２の規定によりなお従前の例によることとされる場合における平成24年11月１日施行の滋賀県建設業者等の不正行為等に対する監督処分の基準第３の２(1)②に該当し、営業停止期間は、60日間とする。
