株式会社鹿野建築の従業者は、同社の業務に関し、法定の除外事由がないのに、令和2年9月28日、同社が請け負った豊橋市神野新田町地内における事務所・プラットホーム境屋根雨漏り補修工事現場において、同工事の下請負人の労働者に、同工事の発注者のトラックヤードの屋根を作業床として堅樋の取り付け作業を行わせるに当たり、同作業床は地上から約6.14メートルの高さに位置し、墜落により労働者に危険を及ぼすおそれのある箇所であったにもかかわらず、同所に囲い、手すり、覆い等を設けず、もって下請負人の労働者の労働災害を防止するため必要な措置を講じなかったものである。 このことが、労働安全衛生法に違反し、豊橋簡易裁判所より、法人及び従業者が罰金20万円の略式命令を受け、その刑が確定した。 これは、建設業法第28条第1項第3号に該当する。
