有限会社鈴政工業の営業部長である従業者は、同社が請け負った愛知県西尾市花蔵寺町地内におけるたん水防除事業室場南部地区上屋建築工事の施工管理及び安全管理を統括するものであるが、同社従業者は、同社の業務に関し、令和４年３月17日、前記工事現場において、同社が下請負人をして資材等仮置き用のステージ設営作業を行わせていた支保工の高さは地上から約４メートルであって、踏み抜きにより労働者に危険を及ぼすおそれがあったのであるから、関係労働者以外の労働者を立ち入らせないようにするための措置を講じなければならなかったにもかかわらず、その措置を講じることなく関係労働者以外の労働者である者を立ち入らせ、もって労働者が墜落するおそれのある場所に係る危険を防止する必要な措置を講じなかったものである。 このことが、労働安全衛生法に違反し、岡崎簡易裁判所より、法人及び従業者がそれぞれ罰金20万円の略式命令を受け、その刑が確定した。 これは、建設業法第28条第１項第３号に該当する。
