On May 16, 2022, Lin Kogyo Co., Ltd. conducted waterproofing work on a rooftop of a condominium in Chuo Ward, Sapporo, using the rooftop as a work platform at a height of 31.49 meters. The company did not install guardrails or similar safety barriers around the rooftop's edges, despite the feasibility of doing so, thereby failing to take necessary safety measures to prevent falls. As a result, the company and its officers were sentenced to fines by the Sapporo Summary Court based on Article 21, Paragraph 2 of the Industrial Safety and Health Act and Article 519, Paragraph 1 of the Industrial Safety and Health Regulations. This constitutes a violation under Article 28, Paragraph 1, Item 3 of the Construction Business Act. The authority responsible for the enforcement was Hokkaido, and the case was reported through the mutual construction industry reporting system of the Hokkaido Labour Bureau.

林工業株式会社は、令和４年５月 16 日に札幌市中央区の工事現場で、作業員に高さが 31.49ｍあるマンションの屋上を作業床として使用させて防水工事を行わせるにあたり、同屋上は墜落により作業員に危険を及ぼすおそれがあり、同屋上に囲い等を設けることが困難ではなかったので、同屋上の周囲の端に囲い等を設けなければならなかったのに、これを設けることなく工事を行わせ、もって作業員が墜落するおそれのある場所に係る危険を防止するための必要な措置を講じなかったものである。 このことにより、労働安全衛生法第 21条第２項及び労働安全衛生規則第519条第１項に基づき、札幌簡易裁判所において、同法人及び同法人役員が罰金刑に処せられ、刑が確定した。 このことは、建設業法第２８条第１項第３号に該当するものである。
