立森建設株式会社の取締役が、同社の業務に関し、廃棄物の処理及び清掃に関する法律（昭和４５年法律第１３７号）第１６条の２（焼却禁止）の規定に違反し、令和３年５月１２日に岡山簡易裁判所から同社は罰金５０万円、取締役は罰金２０万円の略式命令を受け、その刑が確定している。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
