Despite this, the company did not assign a guide to direct the drag shovel, nor took necessary safety measures to prevent accidents. This constituted a violation of the Labor Safety and Health Act. The Kuwana Summary Court issued a summary order imposing a fine of 200,000 yen on the company and its director, which was finalized. This action falls under Article 28, Paragraph 1 of the Construction Business Act.

株式会社カワセ土木の代表取締役は、同社の管理責任者として業務を統括管理し、同社が請け負った三重県桑名市新西方三丁目地内における造成工事において労働者の安全を管理していたものであるが、同社の業務に関し、令和４年６月14日、同工事現場において、労働者に車両系建設機械であるドラグ・ショベルを運転操作させて不要な残土を地面に下ろす業務を行わせるに当たり、同所は、高さ約２．７メートルの擁壁上付近に位置する傾斜地等であり、同ドラグ・ショベルの転倒又は転落により労働者に危険が生ずるおそれがあったのであるから、誘導者を配置して同ドラグ・ショベルを誘導させるなどの措置を講じなければならないのに、誘導者を配置しないまま前記労働者に同ドラグ・ショベルを用いて前記業務を行わせ、もって機械等による危険を防止するための必要な措置を講じなかったものである。 このことが、労働安全衛生法に違反し、桑名簡易裁判所より、法人及び代表取締役が罰金20万円の略式命令を受け、その刑が確定した。 これは、建設業法第28条第１項第３号に該当する。
