ＪＲ九州住宅株式会社は、建設業法第3条第1項第2号に規定する特定建設業の許可を有していないにもかかわらず、2つの民間工事において元請業者として同号の政令で定める金額（6,000万円）を超える下請負契約を締結した。 同社は、民間工事において、建設業法第3条第1項の許可を受けないで建設業を営む者と同法施行令第1条の2第1項で定める軽微な工事の範囲を超えて下請負契約を締結した。 同社は、平成29年7月1日から平成30年3月10日にかけて施工した民間工事において、他社の在籍出向者を主任技術者として配置していた。
