株式会社久保建設の元代表取締役は、愛媛県が入札を執行した２件の工事に関し、当時の愛媛県職員から秘密事項である直接工事費及び調査基準価格の教示を受けて、同社にこれらの工事を落札させ、もって偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為をしたとして、公契約関係競売入札妨害の罪により、懲役１年６月（執行猶予３年）の判決を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
