During excavation, workers were allowed to perform pipe laying work inside a trench. Due to the risk of a landslide of the trench wall soil, the company had a duty to take safety precautions, such as installing shoring, before allowing workers to proceed. The company neglected this duty, leading to a landslide that caused the death of a worker. As a result, on July 11, Reiwa 6 (2024), the Takamatsu Summary Court issued a summary order: the company was fined 300,000 yen for violations of the Industrial Safety and Health Act, and the chief safety and health officer was fined 500,000 yen for violations of the same Act and for professional negligence resulting in death. These penalties have been finalized. This case falls under Article 28, Paragraph 3 of the Construction Business Act.

Cause of action

金本建設株式会社は、同社が請け負った綾歌郡綾川町滝宮地内の導水管更新工事において、掘削した溝内で労働者らに配管敷設作業を行わせるに当たり、壁面土砂の崩落により労働者に危険を及ぼすおそれがあったため、あらかじめ土止め支保工を設けるなど、危険を防止した上で作業をさせるべき業務上の注意義務があったのに、これを怠って作業を行わせた過失により、壁面土砂を崩落させ、労働者を死亡させた。 このことにより、令和６年７月11日、高松簡易裁判所から、同社は労働安全衛生法違反により罰金30万円、同工事の統括安全衛生責任者は労働安全衛生法違反及び業務上過失致死の罪により罰金50万円の略式命令を受け、それぞれの刑が確定している。 このことは、建設業法第28条第３項（同条第１項第３号該当）に該当する。
