イシマル土木株式会社の元代表取締役は、元防府市職員に対し、防府市上下水道局が発注する工事の積算に使用する資材の単価に係る情報の教示を受けるなど有利かつ便宜な取り計らいを受けたことに対する謝礼及び今後も同様の取り計らいを受けたいとの趣旨の下、プロ野球観戦チケット等を供与し、もって元防府市職員の職務に関して賄賂を供与した。 このことにより、令和６年１月５日に山口地方裁判所から刑法第１９８条（贈賄）違反による懲役１０月（執行猶予３年）の判決を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当するものと認められる。
