荒牧空調工業株式会社は、建設業法第27条の23第１項に規定する経営事項審査を継続して受審せず、同法施行令で定める建設工事を発注者から直接請け負うことができない期間が生じていたにもかかわらず、この間にさくら市が発注する氏家小学校ほか給食室空調機改修工事を直接請け負っていた。このことは、建設業法第28条第１項本文に該当すると認められる。
