環境エンジニアリング株式会社は、令和３年８月３１日及び令和４年８月３１日を審査基準日とする経営事項審査において、資格要件を満たさない者を技術職員名簿に記載し虚偽の申請を行うことにより得た経営事項審査結果を公共工事の発注者に提出し、公共発注者がその結果を資格審査に用いた。また、県内の複数の工事現場において、資格要件を満たさない者を主任技術者として配置していた。このことは、建設業法第２８条第１項第２号に該当すると認められる。
