株式会社はざま建築事務所は、営業所に常勤して専らその職務に従事すべき技術者を、同社が令和２年１月に施工した店舗新築工事において、専任でなければならない主任技術者として配置しており、当該技術者が営業所に専任しているとは認めがたい状態であったことが、令和３年４月２３日に受理した事業年度終了報告において確認された。 このことは、建設業法第７条第２号に違反するため、同法第２８条第１項第２号に該当すると認められる。
