当該建設業者は、大阪市内の民間発注の工事において、建設業法第24条の８第１項及び第４項の規定に違反して、当該建設業者の下請負人であるA社、２次下請負人であるＢ者を施工体制台帳及び施工体系図に記載せず、Ｃ社、Ｄ者、Ｅ社、Ｆ社、Ｇ社、Ｈ社、Ｉ社、Ｊ者、Ｋ社、Ｌ者等の当該建設業者の下請負人との下請契約に係る同法第19条第１項及び第２項の規定による書面（請負契約書等）の写しを施工体制台帳に添付せず、建設業法施行規則（昭和24年建設省令第14号）第14条の２第１項第２号チ及び同項第４号チに掲げる事項（いわゆる「作業員名簿」）のうち一部の下請負人の建設工事に従事する者に関する「社会保険の加入等の状況」などを記載しないなど、施工体制台帳及び施工体系図の一部の作成を怠った。
