奈良県御所市が発注した御所市新火葬場整備事業建設工事の入札に関して、株式会社ゴセケンの元代表取締役２名は、株式会社ゴセケンを代表企業とする特定建設工事共同企業体を受注させるために御所市市議会議員が便宜を図ったことへの謝礼として、賄賂を供与した。これにより元代表取締役２名は、令和５年６月１２日に大阪地方裁判所において刑法６０条及び刑法１９８条により懲役３年（執行猶予５年）と懲役２年６月（執行猶予５年）の判決を受け、その刑が確定している。 このことが、建設業法第２８条第１項第２号及び第３号に該当すると認められる。
