髙橋土建株式会社の前代表取締役は、山形県住宅供給公社発注の山形北インター産業団地造成工事に伴う建設残土運搬工事の指名競争入札に関し、同公社職員から入札に関する秘密事項の教示を受けて、同社に工事を落札させ、もって偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為をしたとして、公契約関係競売入札妨害の罪により、懲役１年（執行猶予３年）の判決を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
