株式会社福田建設は、福島県発注の応急仮設住宅撤去業務（好間工業団地第三）において、追加工事に関する変更契約で書面の交付を行っていなかった。 また、二次下請業者がいることを把握していたにも関わらず、施工体制台帳及び施工体系図に記載していなかった。 このことは、建設業法（昭和２４年法律第１００号）第１９条第２項並びに第２４条の８第１項及び第４項に違反し、同法第２８条第１項本文に該当する。
