Cause of action

（株）伏見建築事務所は、奈良市内の家屋改修工事において、住宅内の高さ３．４０メートルの２階床梁上で行う大工作業について、足場を組み立てる等の方法により作業床を設けることが困難であるときは、防網を張り、労働者に要求性能墜落制止用器具を使用させる等の措置を講ずべきところ、その措置を講じていなかった。 その結果、令和３年９月３日、２階床梁上で大工作業を行っていた労働者が墜落し、１階のコンクリート土間に頭部を強打し、死亡した。 このことにより、（株）伏見建築事務所は労働安全衛生法第２１条第２項及び労働安全衛生規則第５１８条第２項違反に問われ、奈良簡易裁判所から罰金２０万円に処する旨の略式命令を受け、令和４年１月２６日に当該命令が確定した。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
