株式会社エステー建設は、令和４年12月15日、天童市内の舗装工事現場において、貨物自動車の荷台から道板を使用してドラグ・ショベルを降ろす際に、転倒、転落等による危険を防止するために必要な措置を講じなかったため、ドラグ・ショベルが横転し、ドラグ・ショベルを操縦していた作業員が死亡する事故を発生させた。 このことが労働安全衛生法に違反するとして、株式会社エステー建設及び同社代表取締役それぞれが山形簡易裁判所から罰金20万円の略式命令を受け、令和５年４月25日にその刑が確定した。 このことは、建設業法第28条第1項第３号に該当する。
