On May 25, 2021, S.S. K.K. failed to observe necessary safety precautions while operating an excavator at a construction site in Tome City, Miyagi Prefecture. The excavator's bucket collided with a worker, who was subsequently crushed by a dump truck, leading to the worker's death. On September 8, 2022, the Tome Summary Court issued a summary order that the company violated the Industrial Safety and Health Act (Act No. 57 of 1972), and that an employee of the company, who was operating the excavator at the time, was fined for violations of the same law and for professional negligence resulting in death. Both penalties were finalized. This constitutes a basis for suspension of business under Article 28, Paragraph 3 of the Construction Business Act.

株式会社エスエスケーは、令和３年５月２５日に、登米市内の工事現場でバックホーを旋回させる際に必要な業務上の注意義務を怠り、バックホーのバケット部分を自社作業員に衝突させた上、ダンプカーに挟んで、当該作業員を死亡させた。 これにより、令和４年９月８日に登米簡易裁判所から、同社は労働安全衛生法（昭和４７年法律第５７号）違反により、当日安全管理を行うとともに自らバックホーを運転していた同社従業員（当時）は労働安全衛生法違反及び業務上過失致死罪によりそれぞれ罰金刑に処する旨の略式命令を受け、いずれもその刑が確定した。 このことは、法第２８条第１項第３号に該当する。
